FDA Says It'll Regulate E-Cigarettes As Tobacco Merchandise

On April 25th, 2011 in a press release posted on the FDA's internet site, the FDA finally acknowledged what the courts told them on several occasions; the electronic cigarette is just not a medical device or new drug, but rather a tobacco item. Within the press release they are clear that absent any therapeutic claims for instance the capability to help smokers quit smoking, the e-cigarette is indeed a tobacco item. What exactly is not clear is what regulations will probably be imposed.

Several e-cigarette advocates hail this news as a win for the electronic cigarette also as for proponents of the reduced harm philosophy. And although we agree this was a required step towards the end objective, the question nonetheless remains of how precisely the FDA will treat the e-cigarette. Too lots of regulations with high marketplace entry expenses could stifle the industry and give the benefit to standard tobacco cigarettes. Not sufficient regulations could mean a negative perception of the technology in general.

What's important isn't that the FDA realizes that it didn't have a option in the categorization of the smokeless cigarette, but rather what it does next. The courts had already decided the relative category of the item. What the courts didn't say (and won't) is what regulations will likely be in play.

We hope the FDA takes a thoroughly scientific approach to e-cigarette regulation.
